1. Acceptance of Terms

By accessing our website (www.dbrecover.com), downloading our software, using free DBRECOVER for MySQL software, or purchasing an Oracle license, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

3. Software License

3.1 License Grant

DBRECOVER is provided according to the following product terms:

• DBRECOVER for Oracle: Upon purchase, you are granted a non-exclusive, non-transferable license bound to one specific database name (DB_NAME). The license cannot be transferred to a different database.
• DBRECOVER for MySQL: The software is free to download and use. No MySQL license purchase is required.

3.2 Restrictions

You may NOT:

• Redistribute, sell, lease, or sublicense the software
• Reverse engineer, decompile, or disassemble the software
• Remove any proprietary notices or labels
• Use the software for illegal purposes
• Share Oracle license keys with third parties

4. Purchases and Payments

4.1 Pricing

Oracle license prices are displayed in US Dollars (USD). DBRECOVER for MySQL is free software. We reserve the right to change prices or product terms at any time without notice.

4.2 Payment Processing

DBRECOVER for Oracle software licenses are sold by ThreeGem Co., Ltd. Payments are processed securely through Stripe. We do not store credit card information on our servers. DBRECOVER for MySQL does not require a Stripe checkout.

4.3 7-Day Satisfaction Guarantee

DBRECOVER for Oracle software licenses include a 7-day satisfaction guarantee. If you are not satisfied with the Oracle software license, you may request a refund within 7 calendar days of purchase.

To help us improve DBRECOVER, refund requests must be submitted through the refund request form and include a recovery feedback report with the following information:

• Purchase email or Stripe receipt email
• Product purchased: DBRECOVER for Oracle
• Database type and version
• Operating system, Java/JRE version, machine resources, and DBRECOVER version/build
• Recovery mode or workflow, preview result, failure point, export format, and affected tables or schemas
• Recovery scenario, such as corruption, ransomware, deleted table, dropped database, or no backup
• Error messages, logs, or screenshots if available
• Trial or licensed-version test result
• Expected result and actual result

Do not send full database files or confidential production data with a refund request unless we explicitly request it through a secure support channel.

Refunds apply to software license fees only. Paid technical support, custom recovery work, remote assistance, and other professional services are billed separately and are not covered by the automatic 7-day software refund policy once delivered.

If a refund is granted, the refunded license is terminated. You must stop using that license and must not copy, share, publish, exchange, resell, sublicense, transfer, or otherwise distribute the refunded license key.

Refunds are returned to the original payment method. We may decline refund requests submitted after the 7-day period, requests without the required recovery feedback after follow-up, or requests involving license misuse, redistribution, or other violations of these Terms. If the form is unavailable, send the same report to [email protected].

5. Free Trial and Free MySQL Software

We provide an Oracle trial version and free DBRECOVER for MySQL software. These allow you to:

• Scan and analyze your database files
• Preview recoverable data
• Verify compatibility with your system

You are responsible for testing Oracle software thoroughly before purchasing. We strongly recommend using the Oracle trial to confirm data recoverability. DBRECOVER for MySQL does not require purchase.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

We do not guarantee data recovery results. Recovery success depends on the extent of file damage, data overwriting, and other factors beyond our control.

7. Limitation of Liability

IN NO EVENT SHALL THREEGEM CO., LTD. BE LIABLE FOR ANY:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from the use or inability to use the software

For paid Oracle licenses, our total liability shall not exceed the amount paid for the software license. For free DBRECOVER for MySQL use, our total liability is limited to the maximum extent permitted by law.

8. Technical Support

Oracle software licenses and free MySQL software do not include technical support. The tools are provided for self-service use. Paid support services are available separately upon request.

DBRECOVER and its associated logos are trademarks of ThreeGem Co., Ltd. All rights reserved.

Oracle® and MySQL® are registered trademarks of Oracle Corporation. DBRECOVER is not affiliated with, endorsed by, or sponsored by Oracle Corporation.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes shall be resolved in the courts of Fukuoka, Japan.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services constitutes acceptance of the modified terms.
